1. Applicability and Scope
The following General Terms and Conditions (hereinafter referred to as “GTC”) apply to all business relationships between Pandally Solutions GmbH (hereinafter referred to as “Pandally”, “Fusion Arena”, “us” or “we”), which is the sole owner and operator of Fusion Arena Bern, St. Gallen and Zurich, and the customers (hereinafter referred to as “Customer” or “you”) for services (hereinafter referred to as “Service/s”) provided by us.

Individual agreements concluded with the customer take precedence over these GTC. Conflicting conditions of the customer are not recognized.
The following provisions regarding services also apply accordingly to the sale of goods in our physical retail stores.
Pandally reserves the right to change these GTC at any time. All changes become effective upon publication of the new GTC on the website. The relevant point in time for the applicability of the valid GTC is the time of the binding appointment booking for the receipt of the service.
Please read these GTC carefully before booking an appointment with us. By making a binding appointment, you agree to the following terms and conditions as well as our Privacy Policy.
2. Offer and Prices
Our offer and our prices correspond to those stated on the website and in the store. All prices are quoted in CHF (Swiss Francs) and include statutory VAT unless otherwise noted.
Pandally reserves the right to change its offers and prices at any time. Offers are subject to change and are not to be understood as a binding offer. Pandally cannot guarantee that the listed services will be available at the time of the service. Therefore, all information regarding the services is provided without guarantee and can change at any time and without notice.
3. Payment Options
The following payment options are generally available to the customer for purchasing our services online:
Pandally charges an administrative fee of CHF 15 for the 2nd reminder and an administrative fee of CHF 30 for the 3rd reminder. If payment is not made by 2 working days before the scheduled appointment, the amount owed must be settled on-site directly before the scheduled appointment.
In the event of an unsuccessful dunning process, the amount owed may be assigned to a debt collection company. The company commissioned with the collection will assert the outstanding amounts in its own name and on its own account and may charge additional processing fees.
In exceptional cases, the following payment options may be provided for the payment of our services on-site:
By choosing the payment method, the customer authorizes the payment either by entering credit card details or the access data of a payment service provider. The customer authorizes Pandally to receive or collect payments in the corresponding manner. Should chargebacks occur, Pandally is entitled to reimbursement of the associated costs and bank processing fees. Pandally reserves the right to change the offered payment options at any time.
4. Appointment Booking/Conclusion of Contract
Appointments can be made via our online reservation system, by telephone, or by email. The contract for the service, i.e., the binding booking, is concluded upon our confirmation of the appointment, including the associated delivery of your invoice via email.
Pandally reserves the right to cancel or reschedule an appointment due to unforeseen circumstances (e.g., staff illness, safety concerns, or natural disasters) without any costs or compensation being due.
5. Adjusting/Postponing, Canceling, or Failing to Attend the Appointment
Should the customer adjust, postpone, cancel, or fail to attend the agreed appointment for any reason whatsoever, the following provisions apply:

Heavily discounted and time-limited offers cannot be adjusted or postponed.
Up to 30 days before the scheduled appointment:
No restrictions on adjusting/postponing the appointment. Reductions in booking volume will be refunded as a voucher at 100%, valid for 2 years.
Up to 14 days before the scheduled appointment:
A reduction in the number of participants of 50% or more must be treated as a cancellation and rebooking. Postponing to a new date may be subject to conditions (weekday or booking time restrictions). Reductions in booking volume will be refunded as a voucher at 100%, valid for 2 years.
Up to 7 days before the scheduled appointment:
A reduction in the number of participants of 50% or more must be treated as a cancellation and rebooking. Postponing to a new date may be subject to conditions (weekday or booking time restrictions). Reductions in booking volume will be refunded as a voucher at 50%, valid for 2 years.
Less than 7 days before the scheduled appointment:
A reduction in the number of participants of 2 or more must be treated as a cancellation and rebooking. Postponing to a new date will be subject to conditions. Reductions in booking volume will be refunded as a voucher at 50%, valid for 2 years.

Heavily discounted and time-limited offers will not be refunded.
Up to 30 days before the scheduled appointment:
Booking volume will be refunded as a voucher at 100%, valid for 12 months. An extension of the voucher is excluded.
Up to 14 days before the scheduled appointment:
Booking volume will be refunded as a voucher at 50%, valid for 12 months. An extension of the voucher is excluded.
Up to 7 days before the scheduled appointment:
Booking volume will be refunded as a voucher at 25%, valid for 12 months. An extension of the voucher is excluded.
Less than 7 days before the scheduled appointment:
No refund is provided. Pandally reviews each case individually.
Failure to Attend
Arrival and check-in at the arena more than 5 minutes late:
Shortening of the booked appointment. The experience will be stopped early if a subsequent booking is scheduled.
Arrival and check-in at the arena more than 15 minutes late:
Forfeiture of the claim to the booked appointment. Handled as a no-show if subsequent appointments are scheduled.
No-show on the scheduled date
No refund is provided.
NOTE: Please contact us early if you expect to arrive late so that we can discuss possible solutions with you.
6. Liability
Pandally excludes all liability, regardless of its legal basis, as well as claims for damages against Pandally and any auxiliary persons or agents. In particular, Pandally is not liable for indirect damages and consequential damages, lost profits, or other personal, property, and pure financial losses of the customer. Further mandatory legal liability, such as for gross negligence or unlawful intent, remains reserved.
Events outside our control
In the event of an occurrence outside our control (so-called force majeure), we assume no liability or responsibility for the non-performance or delayed performance of any obligations under these GTC. An event outside our control includes, for example, strikes, fire, explosions, storms, floods, earthquakes, epidemics, or pandemics.
Furthermore, we decline any liability for damages resulting from the use of the website, the online booking system, and the external links contained therein. Pandally is likewise not liable for the unauthorized acquisition of personal user data by third parties (e.g., through unauthorized access by hackers to databases).
7. Data Protection
Pandally collects and processes personal data only within the framework of legal provisions. Further information can be found in our Privacy Policy, which forms an integral part of these GTC.
8. Copyright
The information and content published on the website are protected by copyright and are the property of Pandally or the respective rights holder. Reproduction, processing, distribution, or any other form of utilization requires prior written consent.
9. Severability Clause
Should any provision of these GTC be illegal, invalid, or unenforceable, this shall not affect the validity of the remaining provisions. The ineffective provision shall be deemed replaced by an effective provision that comes closest to the economic purpose.
10. Applicable Law and Jurisdiction
These GTC and the contractual relationships based on them are exclusively subject to substantive Swiss law. The place of jurisdiction for natural persons is the registered office of Pandally or the customer’s place of residence. For legal entities, the registered office of Pandally is the exclusive place of jurisdiction.
11. Changes
These GTC may be changed from time to time and without prior notice. All changes apply, unless otherwise stated, when they are published on the website.
